Conditions of participation TikTok competition "10,000 followers special" from September 14th, 2021
The following conditions (“Conditions of Participation”) apply to participation in the “10,000 Followers Special” competition (hereinafter “Competition”).
The competition is organized by Petra Wolf (@petrawolfsheart), Winzererstr. 27, 80796 Munich
The giveaway is not affiliated with TikTok Inc. and is in no way sponsored, endorsed or administered by TikTok Inc. All questions, comments and complaints should not be directed to TikTok Inc., but should be directed to the Promoter. By confirming the terms and conditions, participants acknowledge that they cannot acquire any claims against TikTok Inc. by participating in the promotion.
1 participation
1.1
Eligible to participate are natural persons residing in the Federal Republic of Germany who have reached the age of 16. The organizer reserves the right to request proof of age.
1.2
Participation can only take place via the Internet and requires registration in the online community TikTok.
1.3
Participation is voluntary and free of charge. The participants (in the following, personal designations apply equally to male and female persons) only have to bear the costs associated with participating via the Internet (user fee for Internet connection).
1.4
Participation is by liking and commenting on the "10,000 Follower Special" video by @petrawolfsheart on TikTok (posted on September 14th, 2021). The participant has to press the Like button and think of a name for the raffled painting by Petra Wolf, which he then posts in the comments.
1.5
It may only be entered once per person. Participation via lottery services, automated mass participation procedures of third parties, agencies or other commercial providers is not permitted.
1.6
By commenting on and liking the video, the participant agrees that the organizer can repost the winning comment publicly and on other social media profiles (such as Instagram). The privacy settings on your own profile are not affected.
1.7
In the event of a breach of these conditions of participation, the organizer reserves the right to exclude the participant from the competition. If necessary, winnings can be subsequently withdrawn and reclaimed in these cases.
2 promotional period
The competition will be held from September 14, 2021 (00:00) to September 21, 2021 (23:59). The winner will be drawn at random on September 22, 2021.
3 Implementation of the Sweepstakes
3.1
The competition will be conducted exclusively via TikTok.
3.2
Participation is by liking and commenting on the "10,000 Follower Special" video by @petrawolfsheart on TikTok (posted on September 14th, 2021). The participant has to press the Like button and write a comment on the subject of art.
3.3
After the closing date for entries, 1 winner will be randomly drawn from among all participants and informed of the prize by personal message via their profile on TikTok, which was used to participate in the competition.
The winner must confirm the prize by sending a personal TikTok message to Petra Wolf (@petrawolfsheart) on TikTok, stating their first and last name, shipping address and email address within seven (7) calendar days, otherwise the claim will be forfeited on the prize and a new winner will be determined from the remaining participants.
To be raffled:
- 1 x 1 acrylic painting on canvas / 40x40x4cm
The organizer reserves the right to change the conditions of participation at any time if this is necessary for the proper execution of the competition for legal or factual reasons. He also reserves the right to end the competition or to temporarily suspend it if proper execution of the competition is impossible for legal or factual reasons.
The non-cash prize will be sent by Petra Wolf by parcel service or post to the address given by the winner. The shipping costs are borne by the organizer.
The item presented as a prize in the video as part of the competition is identical to the item won. However, there may be deviations in color or similar.
Cash payment of the prizes or any winning set is not possible. The profit claim is non-transferable.
4 Entrants' Responsibility for Submissions
4.1
No infringing, defamatory, malicious or personal rights infringing content may be published. No information or content that is harmful to young people may be distributed. Furthermore, racist, violent, violence-glorifying, politically extremist, sexist, discriminatory or otherwise objectionable publications, as well as those that insult, slander, threaten or verbally disparage other people, ethnic groups or religious denominations are not permitted. No commercial or political advertising may be published. This prohibition relates to political content that is not compatible with the values of the Basic Law of the Federal Republic of Germany. The participant undertakes not to infringe any rights of third parties (e.g. copyright, personal rights and/or trademark rights). The organizer reserves the right to delete entries from participants or to exclude them from the competition if they violate one of the aforementioned provisions.
4.2
By posting his comment, the participant declares that the contribution is free of third-party rights, i.e. that the contribution either comes from him/her or he has the respective consent of the author and can prove this consent to the organizer at any time. The participant also assures that no other rights of third parties, in particular no copyrights, personal or trademark rights, are violated by the comment and that the comment does not contain any content that glorifies violence, is criminally relevant, pornographic or otherwise offensive or infringes the law.
4.3
The participant exempts the organizer from all claims that third parties have made or should make against the organizer as a result of the entry. The participant also agrees to provide reasonable support in defending against such claims at any time. Any further claims for damages by the organizer against the participant remain unaffected.
4.4
The organizer is not obliged to check the comment uploaded by a participant for potential violations of the rights of third parties. However, the organizer is entitled to reject comments, delete comments or exclude the participant from participation at any time and without explanations or prior notice if a comment is illegal, offends common decency or is otherwise inappropriate in the opinion of the organizer.
5 Use Rights
5.1
By liking and commenting on the video, the participant expressly agrees that the contribution provided by him/her may be used to process the competition and to present the participant contributions on the organizer's social media profiles (TikTok: @petrawolfsheart ; Instagram:@petrawolfsheart) is used, in particular reproduced, distributed and made publicly available to third parties. For these purposes, the organizer is also permitted to grant third parties the right to use the contributions. These rights are granted free of charge and without spatial or temporal restrictions.
5.2
In cases where the participant revokes their consent to the use of the entry, they are automatically no longer entitled to continue participating in the competition. There are no further disadvantages for the participant.

6.3
The prerequisite for participation in the competition is that the participant likes the video for the "10,000 Follower Special" and then writes a comment with a name suggestion for the painting that is being raffled off. I use this comment to determine the winners. I use the participant's TikTok profile name to assign the contribution and to contact me via direct message. In the case of winning, the participant must send me his first and last name and his address; I use this to post the prize. I also use the name to ensure personal and professional support.
6.4
The legal basis for data processing in the context of the competition is Art. 6 Para. 1 lit. a GDPR (which allows data processing on the basis of consent) and Art. 6 Para. 1 lit. b GDPR (which stipulates the processing of data to fulfill a contract or pre-contractual measures allowed). We therefore ask the participant to give his/her declaration of consent in accordance with Section 7.5 of these Conditions of Participation below. The provision of data by the participant is voluntary. However, participation in the competition is not possible without the data.
6.5
By posting my comment under the "10,000 Follower Special" video, I consent to Petra Wolf stored and processed.
I also agree that my post may be reposted on Petra Wolf's TikTok channel @petrawolfsheart. This makes it clear to all visitors of the WOLF'S HEART by Petra Wolf channel on TikTok that I took part in the competition.
I can return my declaration of consent to Petra Wolf at any time with effect for the future, keyword: "TikTok competition, Winzererstr. 27, 80797 Munich or by email to info@wolfs-heart.de. There are no special fees (beyond the regular transmission fees). (Further) participation in the competition is not (or no longer) possible if you do not give or withdraw your consent.
6.6
After the end of the competition, the organizer will delete all data collected, unless they are to be retained for a longer period due to statutory retention requirements.
6.7
As a data subject, you can send an informal message to the above contact details at any time in order to exercise your rights under the GDPR. All information provided by the organizer is provided without guarantee.
7.2
The organizer is not liable for the availability of the online community TikTok.
7.3
Insofar as the winner asserts claims in connection with the prizes received, these are to be addressed directly to the manufacturer/dealer, supplier, tour operator or other service provider, insofar as this is legally permissible. Should the organizer have any claims in this regard, these will be assigned to the respective winners.
7.5
The above limitation of liability applies in particular to damage caused by errors, delays or interruptions in the transmission of data or similar, disruptions to the technical systems or the service, incorrect content, loss or deletion of data, viruses.
8.1
The law of the Federal Republic of Germany is applicable.
8.2
Should any of these provisions be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
8.3
The organizer reserves the right to change or correct the conditions of participation - within the scope of what is legally permissible.
